1. Services Overview

The Mac Space: Mac Repair provides Apple device repair services, diagnostics, data recovery, and related technical services. Our customer portal allows you to:

• Track the status of your repairs
• View repair history and documentation
• Access signed agreements and invoices
• Communicate with our repair team
• Schedule appointments and services

2. Account Registration and Security

To access certain features of our portal, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security and confidentiality of your login credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

3. Device Repair Agreement

All repair services are subject to our Device Repair Agreement (DRA), which is presented and signed at the time of device intake. The DRA contains important terms regarding:

• Data responsibility and backup requirements
• Warranty coverage and limitations
• Payment terms and device abandonment policies
• Parts sourcing and manufacturer limitations
• Liability limitations and indemnification

The Device Repair Agreement is incorporated into these Terms of Service by reference. In the event of any conflict, the DRA shall govern repair-specific matters.

4. Acceptable Use Policy

You agree to use our services and portal only for lawful purposes. You shall not:

• Use the portal to transmit harmful, offensive, or illegal content
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the integrity or performance of our services
• Use automated systems or software to extract data from our portal
• Impersonate any person or entity or misrepresent your affiliation
• Upload or transmit viruses, malware, or other malicious code
• Violate any applicable local, state, national, or international law

5. Intellectual Property

All content on our website and portal, including but not limited to text, graphics, logos, images, software, and documentation, is the property of The Mac Space: Mac Repair or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from our services without our express written permission.

6. Payment Terms

Payment for services is due as specified in your invoice or repair agreement. We accept various payment methods including credit cards, debit cards, cash, and approved financing options.

• All prices are in U.S. dollars unless otherwise specified
• Diagnostic fees are non-refundable and applied toward repair costs
• Custom-ordered parts may require advance payment
• Failure to pay may result in device retention as described in the DRA

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our total liability for any claim shall not exceed the amount you paid for the specific service giving rise to the claim
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• We are not responsible for data loss, software corruption, or hardware failure beyond our control
• We are not liable for delays caused by parts availability, shipping, or circumstances beyond our control

8. Disclaimer of Warranties

Our website, portal, and online services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not warrant that:

• The services will be uninterrupted, secure, or error-free
• The results obtained from using the services will be accurate or reliable
• Any errors in the services will be corrected

Repair service warranties are governed by the Device Repair Agreement and your specific invoice.

9. Indemnification

You agree to indemnify, defend, and hold harmless The Mac Space: Mac Repair, its officers, directors, employees, and agents from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of our services or violation of these Terms
• Your violation of any third-party rights
• Any content you submit or transmit through our services
• Your negligent or wrongful conduct

10. Termination

We reserve the right to suspend or terminate your access to our portal at any time, with or without cause, and with or without notice. Upon termination:

• Your right to use the portal will immediately cease
• We may delete your account and associated data (subject to legal retention requirements)
• Provisions that by their nature should survive termination shall remain in effect

11. Dispute Resolution

In the event of any dispute arising from these Terms or our services:

1. Informal Resolution: Both parties agree to first attempt to resolve the dispute through good-faith informal negotiations for at least thirty (30) days
2. Binding Arbitration: If informal resolution fails, the dispute shall be resolved through binding arbitration in the State of Georgia
3. Governing Law: These Terms shall be governed by the laws of the State of Georgia, without regard to conflict of law principles

12. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after any changes constitutes acceptance of the modified Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms of Service, together with our Privacy Policy and Device Repair Agreement, constitute the entire agreement between you and The Mac Space: Mac Repair regarding your use of our services and supersede all prior agreements and understandings.
